By using the ElderCheck voice assistant device and service ("Service"), you ("User" or "you") accept and agree to be bound by these Terms of Service. If you are a family member or caregiver setting up ElderCheck for another person, you represent that you have authorization to accept these terms on their behalf.
2. Service Description
ElderCheck is a voice-first AI assistant designed to help independent seniors maintain their autonomy through:
- Proactive daily check-ins and wellness conversations
- Smart voice reminders for medications, appointments, and daily activities
- Always-on voice interface with senior-optimized interaction
- Family dashboard providing wellness updates and alert notifications
Important: ElderCheck is NOT a medical device, emergency response system, or health monitoring service. It does not provide medical advice, diagnosis, or treatment. In case of emergency, always call 911 or your local emergency services.
3. Device and Service Access
Device Usage
ElderCheck provides a dedicated countertop device that must be connected to the internet to function. You are responsible for:
- Maintaining a reliable internet connection
- Proper care and maintenance of the device
- Returning the device if you cancel your subscription
- Reporting any device malfunction or damage
Account Setup
To use ElderCheck, you must create an account and provide accurate information including:
- User's name and basic contact information
- Family member contact information for dashboard access
- Emergency contact information
- Reminder preferences and check-in schedules
4. Family Dashboard and Data Sharing
The primary user controls what information is shared with family members through the dashboard. By default, family members can:
- View daily check-in completion status
- Receive alerts for missed critical check-ins
- Add and manage reminders remotely
- Access wellness summary information
The primary user may modify these permissions at any time through voice commands or family member assistance. Family members must respect the user's privacy and independence as outlined in our Privacy Policy.
5. Voice Interaction and Data Collection
ElderCheck uses voice recognition and AI to provide its services. By using the Service, you acknowledge that:
- Voice interactions are recorded and processed to provide check-ins and reminders
- Conversations may be stored to improve service quality and AI performance
- Short-term memory features retain recent conversation context
- You can request deletion of voice recordings at any time

6. User Responsibilities and Appropriate Use
Users and family members agree to:
- Use ElderCheck only for its intended purpose of supporting daily independence
- Not rely on ElderCheck as a substitute for professional medical care or emergency services
- Maintain accurate reminder and check-in information
- Respect the primary user's privacy and autonomy
- Not attempt to modify, reverse engineer, or tamper with the device or service
- Not use the service for any unlawful purpose
7. Limitations and Disclaimers
Not a Medical Device
ElderCheck is a companion and reminder service, NOT a medical device, medical alert system, or health monitoring service. It should not be relied upon for:
- Medical diagnosis, treatment, or advice
- Emergency response or fall detection
- Vital sign monitoring or health metric tracking
- Medication management or dosage recommendations
Service Availability
While we strive to provide reliable service, ElderCheck is provided "as is" and "as available." We do not guarantee that the service will be:
- Available at all times without interruption
- Free from errors or technical issues
- Able to detect all missed check-ins or forgotten reminders
- Accurate in voice recognition under all conditions
AI Limitations
The AI assistant may occasionally misunderstand voice commands, provide inaccurate responses, or fail to properly detect user needs. Users should verify important information and not rely solely on the AI for critical decisions.
8. Liability Limitations
To the maximum extent permitted by law, ElderCheck and its affiliates shall not be liable for:
- Any injury, health issue, or emergency not detected or prevented by the service
- Missed reminders, check-ins, or notifications due to technical issues
- Decisions made based on AI interactions or suggestions
- Indirect, incidental, special, or consequential damages
- Loss of data, business interruption, or other commercial damages
Our total liability to you for any claim arising from use of the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Subscription and Cancellation
ElderCheck is provided as a monthly subscription service. You may cancel at any time with notice. Upon cancellation:
- Service will continue until the end of the current billing period
- You must return the device within 30 days
- Your data will be retained according to our Privacy Policy
- You may request data deletion upon cancellation
10. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using ElderCheck, you consent to our data practices as described in the Privacy Policy.
11. Modifications to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via:

Continued use of the service after changes constitutes acceptance of the updated terms.
